Preparing a DUI Defense

Was your DUI arrest legal?

South Carolina DUI law is a complex law, with a surprisingly large gray area of actual DUI culpability. Though, only a DUI attorney can thoroughly evaluate and challenge your DUI arrest. DUI statutes we ll examine include:

  • South Carolina law dictates that the police officer’s video camera must begin videotaping as soon as the officer turns the blue lights on.
  • Prior to administering the breathalyzer test the officer must have read and provided the implied consent notice. stating the consequences of a refusal to submit to a blood test, urine test, or breath test. Learn more about challenging breathalyzer tests.
  • Roadside or field sobriety tests (FST) must have been properly administered, for the result to be used in court. Inaccuracies with FSTs are widespread and commonly challenged. Learn more about challenging field sobriety tests .

Under DUI Law: Guilt Must Be Proven

The South Carolina DUI lawyers at Strom Law Firm, LLC will examine these and other DUI laws to determine the strength or weakness of the case against you.

  • The prosecution must prove that there was a reason, known as reasonable suspicion, for the officer to pull you over. For example, the officer saw you driving recklessly, speeding or swerving over the double yellow line.
  • The prosecution must prove that you were driving any type of motorized vehicle.
  • The prosecution must also prove that you were on the road.
  • Most importantly, the prosecution must establish that you were materially and appreciably impaired.
  • While some statutes are more easily determined than others, the most vital question appears to be whether the defendant was materially and appreciably impaired. This issue is at the core of the argument and presents the biggest challenge in dealing with the DUI statute.

Consequences of a DUI Arrest in South Carolina:

Consequences associated with a driving under the influence conviction are determined by

  • the charge of a first DUI, second DUI, third DUI, or subsequent offense;
  • your blood alcohol level (the higher your BAC, the stiffer the penalties);
  • your agreement or refusal to take a chemical test. such as a breathalyzer (if you refuse, you will lose your license for 6 months, unless you request an administrative suspension hearing) ;
  • minors being in your vehicle; and
  • your involvement in a DUI accident.

NOTE: Your DUI defense also plays a key role in determining the final consequences.

Actual DUI penalties. based on the factors above, include:

  • A suspended or restricted license
  • Mandatory jail time or imprisonment
  • Ignition interlock device
  • SR-22 insurance
  • Fines ranging from $400 to $10,000
  • Community service

James Corden Gets Ewan McGregor to Admit He Pooped His Pants in the 90s (Video)

Wednesday night, Late Late Show viewers finally got an answer to the age-old question: Ewan McGregor. have you ever pooped your pants?

The query came directly from One Direction s Niall Horan, as part of a team Spill Your Guts or Fill Your Guts game. Basically, the players pose each other embarrassing questions, and your opponent must either answer truthfully or eat something truly horrendous. McGregor went ahead and tackled this one head-on, an attempt to avoid downing bird saliva.

I mean, I could lie, there s only one or two people who could know, McGregor said. Well, I guess, yes!

Teammate and host James Corden immediately asked his guest for an age. Well I was very young at the time, the Big Fish star elaborated. It didn t have any age in there, did it?

Corden reminded McGregor that we ve all done it, as babies so that can t possibly count.

I might have s my pants in the 90s, the 45-year-old McGregor replied. One time.

You can do the math.

Also during the game. Isla Fisher revealed whether or not her husband Sacha Baron Cohen has performed a character in bed, Horan picks between exes Selena Gomez and Ellie Goulding, and Corden avoids naming his favorite late-night Jimmy.

Right off the bat, Niall and Isla had to drink err, eat a salmon smoothie so the 1D member didn t have to name his least-favorite boy-bandmate. Corden and McGregor downed some scorpion so the CBS personality didn t have to reveal who he s turned down for Carpool Karaoke.

13 Family-Friendly Halloween Movies, From Hocus Pocus to Goonies (Photos)

Lest we forget, Halloween is more than just jump scares and “slutty (insert profession here)” costumes. From “Hocus Pocus” to “Caspers,” here are the spooky-butPG or below movies to introduce to the next generation.

“Hocus Pocus”
Despite being rated PG, “Hocus Pocus” is a classic, iconic Halloween movie, and its cult status has only gained in the 20 years since its release.

“The Nightmare Before Christmas”
Is it a Halloween movie? A Christmas movie? Nobody knows, but the good thing about this Tim Burton classic is that it can be relied upon all throughout the holiday season.

“It’s the Great Pumpkin, Charlie Brown”
You can mark the changing of the seasons by the classic Peanuts cartoons that celebrates all the major holidays. Halloween is a big one, along with “A Charlie Brown Thanksgiving” and “A Charlie Brown Christmas.”

“Ghostbusters” (2016)
This remake of the 1980s classic has a phenomenal comedic cast of funny ladies, and luckily, this is modern reboot that didn’t go the “dark and grounded” route, making it a fun Halloween adventure, even for kids born with a smartphone in their hands.

“Casper”
A family-friendly coming of age tale and a fun, spooky adventure all in one.

“Beetlejuice”
Michael Keaton plays a mischievous spirit intent on causing chaos, go ahead and say his name three times and he’ll bring plenty of fun — but nothing too scary.

“Coraline”
This claymation adaptation of Neil Gaiman ‘s classic novella follows a girl who discovers an alternate world that’s just this side of creepy. but not too scary.

“Harry Potter” series
Does Halloween even exist in the world of Hogwarts? No matter, because this fantasy epic has spawned millions of costumed fans. And since there’s eight movies, it’s the perfect marathon binge for Halloween weekend.

“The Addams Family”
This quirky, morbid family comedy should be buckets of fun for your Halloween family movie night.

“The Halloween Tree”
Ray Bradbury narrates this adaptation of his own book of the same name, and it’s an Emmy-winning Halloween romp that’s also a history lesson about the origins of the holiday.

“Garfield’s Halloween Adventure”
Garfield tricking Odie into giving him all his candy is about as scary as this pirate-themed ghost story gets, but it did win the Emmy for Outstanding Animated Program.

“Something Wicked This Way Comes”
Carnivals are pretty much never not-scary, but this adaptation of Ray Bradbury ‘s novel is just the appropriate amount of scary.

“Goonies”
A swashbuckling treasure hunt featuring a rag tag team of kids and a “monster” who helps them is a classic. Halloween might be the perfect time to introduce this 1985 hit the next generation of fans.

Security Risks of FTP and Benefits of Managed File Transfer #deep #web #search #engine, #hacker

#

File transfer services such as FTP or HTTP has been the most common way of file transfer for business requirements. Typically what a file transfer means is that a file transfer protocol such as FTP or HTTP is used to send the stream of bits stored as a single unit in a file system including file name, file size, timestamp and other metadata from one host to another host over a TCP-based network such as the Internet.

But this process is not foolproof. FTP, by itself, is not a secure file transfer protocol and it has a lot of security vulnerabilities. It s a known fact that FTP doesn t provide any encryption for data transfer. Most of the times, the requirement in any business is pretty simple: to transfer files between two endpoints in different locations, and the parties involved do not think much about how secure the file transfer process is going to be.

Using FTP for official file transfer can leave your data transmission exposed to many security attacks:

FTP Bounce Attack

Generally a file transfer happens when the source FTP server sends the data to the client which transmits the data to the destination FTP server. When there s a slow network connection, people often resort to using a proxy FTP which makes the client instructs the data transmission directly between two FTP servers. A hacker can take advantage of this type of file transfer and use a PORT command to request access to ports by posing as a middle man for the file transfer request; then execute port scans on hosts discreetly and gain access data transmitted over the network.

FTP Brute Force Attack

An attacker can carry out a brute force attack to guess the FTP server password by implementing a means to repeatedly try different password combinations until they can succeed in the break-in. A weak password and repeated use of the same password for multiple FTP servers can also help the hacker gain quick access. Once the password is guessed, your data is exposed.

Packet Capture (or Sniffing)

Because the data transfer via FTP is in clear text, any sensitive information such as usernames, passwords can be easily read network packet capture techniques such as packet sniffing. A packet sniffer is just a piece of computer program which can capture transmitted data packets and decode the packet’s raw data exposing data contained in the various fields of the packet.

When we restrict access to FTP servers based on the network address, it is possible that a cyber-criminal can use an external computer and assume the host address of a computer on the enterprise network, and download files during data transfer.

When operating systems assign dynamic port numbers in a particular order or pattern, an attacker easily decodes the pattern and identify the next port number which will be used. By illegally gaining access to a port number, the legitimate client trying to access the file will be denied and the hacker can steal files, or even insert a forged file or malicious file into the data stream which will be accessed by other legitimate users in the organization.

As we discussed above, there are a lot of devious means to intercepting an FTP-based file transfer and the chances of your data being exposed is also high. Networks that adhere to federal compliance norms such as PCI DSS, HIPAA, GLBA, etc. and those agencies and institutions that share government data, and customer records are at high risk if they just depend on FTP for file transfer. So, what s the optimum solution if not FTP?

Managed File Transfer Remedies the Vulnerabilities in FTP

Managed file transfer (MFT) is the best option for file transfer compared to all other file sharing methods such as using FTP, HTTP, TFTP, peer-to-peer file sharing and cloud drives. A managed file transfer server facilitates secure file transfer through the Internet by providing a high level of data security. The MFT server software provides secure internal, external and ad-hoc file transfers for both pull-based and push-based file transfers.

Though MFT also uses FTP for data transfer, this type of file transfer ensures the data is protected by using secure FTP (FTPS, SFTP, etc.) With B2B file transfers, especially in a DMZ environment when internal IP addresses need to be concealed, MFT server s authentication and data encryption methods help ensure secure, reliable and auditable file transfer.

MFT is widely used for securely transferring files over public or private networks and you can:

  • Perform secure file transfer via FTP, FTPS, SFTP, HTTP and HTTPS over IPv4 or IPv6 networks
  • Carry out ad hoc file transfer
  • Monitor the file transfer process in real time
  • Get notified of the status once the transfer is complete
  • Report on transfer activity and user access
  • Limit MFT access by user role and integration with Active Directory
  • Transport large wiles with integrity checks and protocol fidelity

When the secure file transfer is concerned at an organizational level, MFT server is the best option that ensures both security and endpoint management simplicity when compared to FTP.

The great umbilical cord-cutting debate

Story highlights

  • Medical studies have shown the positive effects of delayed cord cutting
  • The World Health Organization recommends delayed umbilical cord cutting between 1 to 3 minutes after birth
  • American College of Obstetrician and Gynecologists says most umbilical cords are cut within 15 to 20 seconds after birth

(CNN) For the layperson, a few minutes might tick by without a second thought, but those precious minutes after a baby is born could be beneficial for newborns later in life, some doctors say. When to “clamp” and or cut one of the most prominent fixtures associated with childbirth, the umbilical cord, has been at the center of an international cord-cutting clash for decades.

What started as a grass-roots movement by UK midwife Amanda Burleigh nearly a decade ago, has recently grabbed the attention of medical doctors around the world. “I wanted to find answers to why so many children, including mine, my friends’ and my colleagues’ appeared to have additional learning and health needs, especially the boys,” said Burleigh. So she started reflecting on her own practice as a midwife.

“I began to question why we were trained to cut the umbilical cord immediately after a baby was born,” said Burleigh. “I then started to explore my theory that there must be a link to a child’s health based on when the cord is cut.” Her curiosity grew into a movement.

Doctors say before the mid-1950s, when many babies were delivered by midwives, most cord cutting happened when the umbilical cord stopped pulsating, around five minutes after birth. Despite a growing body of medical evidence, the exact time frame when the cord should be clamped continues to be a controversial topic among the medical community.

According to the American College of Obstetrician and Gynecologists, or ACOG, generally most umbilical cord clamping happens within 15 to 20 seconds after birth. The ACOG does not endorse the practice of delayed cord clamping but rather suggests cord clamping should take place between 30 to 60 seconds after birth, since the ideal timing for cord clamping has yet to be established.

Many international health organizations, including the World Health Organization, now recommend umbilical cord clamping be performed from one to three minutes after birth.

Medical studies have suggested positive effects of delayed cord clamping after birth, including increases in iron stores, blood volume and brain development. In a study released this week in the medical journal JAMA Pediatrics, researchers in Sweden measured the effects of delayed cord clamping on children past infancy and up to four years, a time frame few doctors have examined.

In the study, a group of 263 healthy Swedish full-term babies were randomly split into two groups. One group had their umbilical cords clamped less than 10 seconds after birth. The cords of the other group were clamped three minutes after birth. The two groups were then monitored for four years. The babies with delayed cord clamping performed modestly better on tests assessing their fine motor skills and social skills. The boys in the study displayed the most statistical improvement. The results, researchers say, showed no difference in overall IQ.

Though the results are not dramatic, researchers involved with the study said this is an important step. “It’s incredible to see what a difference an extra three minutes and one-half cup of blood can have on the overall health of a child, especially four years later,” said Dr. Ola Andersson, lead author of the study and a pediatrician at the department of women and children’s health at Uppsala University in Sweden. “This is very promising, but larger studies are necessary,” said Andersson.

At birth an estimated one-third of the baby’s blood is in the placenta. Red blood cells contain hemoglobin, a protein molecule, which carries oxygen to body tissues. At birth, the smallest amount of blood could have a big impact on specific aspects of an infant’s health, doctors in support of delayed cord clamping say.

Doctors in support of delayed cord clamping say there are also external drivers perpetuating the practice of early cord clamping in developed countries. Early cord clamping causes vital blood cells to remain in the placenta, which could be used and stored in stem cell banks, doctors say.

“It’s not a black and white issue,” said Dr. David Hutchon, retired obstetrician from the Memorial Hospital in Darlington, United Kingdom. “Though early cord clamping makes it easier to collect and bank cord blood stem cells — since most of the blood volume remains in the placenta — in turn, the nutrients from the cord blood are not directly delivered to the infant at birth.”

In the past 55 years, early cord clamping has become more popular as the medical protocol for managing the third stage of labor. This has largely been attributed to the need to monitor the cord blood gasses to test if a baby has been starved of oxygen during labor. Lack of oxygen during labor can cause brain damage in later years for some children, doctors say.

“When it comes to labor management practices, we need to find a better way of testing for the cord blood gases as well as getting billions of stem cells out of the cord and placenta after the baby has had its physiological transition and a normal blood volume,” said Hutchon. “We’re getting closer to finding a solution but we’re just not there yet.”

Neonatologist Anup Katheria, director of the Sharp Mary Birch Neonatal Research Institute in San Diego, aims to find alternative ways in which very premature infants who need help with breathing at birth can receive delayed cord clamping without having to be removed from their mother into a separate treatment area.

“The practice of helping babies breathe while waiting to clamp the umbilical cord has been around for a long time; it makes sense for the sickest infants,” said Katheria. “We’re focused on producing evidence that shows the benefits. We think this could become the foundation for practice changing resuscitation techniques, transforming outcomes for the most critical of newborns nationwide.”

Despite the obstacles, Amanda Burleigh said she will continue to champion for delayed cord clamping.

“I’ve been told I’m like the midwifery version of Erin Brockovich, which is a huge compliment,” said Burleigh. “The body of medical evidence is growing in support of stopping immediate cord clamping but there is still a lot of resistance because many people just don’t know about it and it’s always hard to change common practice.”

Antitrust officials reportedly preparing to block insurance mega-mergers

The Justice Department has grown increasingly wary of two health-care megamergers and could decide within the next week whether to attempt to block the deals, according to a person familiar with the situation.

Federal regulators have been mulling over the $54 billion merger between Anthem and Cigna and the $37 billion deal between Aetna and Humana for months, said the person, who spoke on the condition of anonymity to talk about private discussions. Bloomberg News reported Tuesday that the Justice Department was preparing to file lawsuits to block the mergers.

The mergers, which were announced last summer, would transform the health insurance landscape by consolidating the big five insurers into three companies. Those involved in the deals have argued that the mergers would benefit consumers and shareholders, giving the companies more clout to drive better deals with hospitals and physician groups.

But politicians. state regulators and the American Medical Association have raised questions about whether the deals would reduce competition and drive up costs for patients.

“The fundamental problem here is that entry into the health insurance market is so difficult and so many of those who have tried [have failed] that antitrust officials tend to be extremely skeptical,” said Gene Kimmelman, who served as chief counsel for the Justice Department’s antitrust division between 2009 and 2012. He is now president of Public Knowledge, a public interest group.

“Providing affordable health care has been one of the most important issues over the last eight years.”

Bloomberg, citing unnamed people familiar with the matter, reported that the final decision to move forward with a lawsuit would likely come this week or next.
The companies declined to respond to the report.

“We don’t comment on rumors or speculation, but we’re steadfast in our belief that this deal is good for consumers and the health-care system as a whole,” said T.J. Crawford, a spokesman for Aetna. Humana spokesman Alex Kepnes did not respond to messages.

Anthem spokeswoman Jill Becher and Cigna spokesman Matthew Asensio both declined to comment on the Bloomberg report.

A back and forth between state regulators and big insurers is common during mergers. Typically, companies agree to sell off assets that regulators believe would concentrate too much market power.

But the potential Justice Department challenge is significant. Ana Gupte, a senior analyst with Leerink Partners, said she expected Aetna and Humana to countersue the government if the Justice Department files a lawsuit. Anthem and Cigna could consider the same move, but Gupte said that deal has a smaller chance of winning and the players could simply decide to walk away.

Stock prices for all four companies fell Tuesday.

The Obama administration has become increasingly aggressive at enforcing antitrust rules. Earlier this year, oil services giants Halliburton and Baker Hughes abandoned a $34 billion merger, bowing to Justice Department complaints that the deal would lead to decreased competition and higher prices. In December, General Electric called off the $3.3 billion sale of its appliance division to Electrolux of Sweden after facing resistance from the Justice Department.

Regulators have been particularly concerned about consolidation in the health-care industry. In a May speech, Federal Trade Commission Chair Edith Ramirez said consolidation in the health-care industry is accelerating and has helped drive up prices in parts of the country.

Last year, the number of hospital mergers increased 18 percent compared with the previous year, she said. In areas where there is a hospital monopoly, prices are 15 percent higher than those in areas with four or more competitors, and the average in-patient stay in those places is almost $2,000 higher, Ramirez said.

“While most provider mergers are not anti-competitive, the few that are could cause significant competitive harm,” Ramirez said.
